This Privacy Policy explains how I, Zuko Vilakazi ("I", "me", "my"), collect, use, share and protect your personal information when you visit my website, submit an enquiry, or interact with my content. I am committed to handling your information responsibly and in line with South Africa's Protection of Personal Information Act, 2013 (POPIA).
The short version: I only collect the information I need to respond to you and help you with property. I don't sell your information. You stay in control, and you can ask me to access, correct or delete your information at any time.
1. Who is responsible for your information
The "responsible party" (the person who decides how and why your personal information is processed) is:
2. The information I collect
Information you give me
When you complete an enquiry or contact form, I may collect your:
- First name and last name
- Email address
- Phone number
- City or area
- The details of your enquiry (what you tell me about how I can help)
- Your communication preferences and consent choices
Information collected automatically
When you use my website, I (and the services I use) may collect technical information such as your device type, browser, approximate location, pages viewed and how you arrived at the site. This is collected through cookies and similar technologies (see section 11).
Information from social platforms
If you interact with me on YouTube, Instagram, Facebook or TikTok, those platforms may share limited information with me in line with their own privacy settings and policies.
3. How I collect your information
- Directly from you, when you complete a form, email me, or message me.
- Automatically, through cookies and analytics when you browse the site.
- From third-party platforms you choose to engage with (such as social media).
4. Why I process your information
I process your personal information to:
- Respond to your enquiry and provide the guidance or property services you ask for;
- Communicate with you about your enquiry or an active transaction;
- Send you educational content, property updates and marketing — only where you have consented;
- Improve my website, content and services;
- Meet legal, regulatory and professional obligations.
5. The legal basis for processing (POPIA)
Depending on the situation, I rely on one or more of the following grounds permitted by POPIA:
- Your consent — for example, when you opt in to marketing or SMS messages;
- Performance of, or entering into, a contract — for example, to act on your property enquiry;
- My legitimate interests — such as running and improving my business, where this does not override your rights;
- Legal obligation — where the law requires me to process or keep certain information.
6. Marketing & communications
I will only send you marketing or promotional messages where you have given consent. You can withdraw that consent at any time:
- SMS: reply STOP to opt out.
- Email: use the unsubscribe link in any message, or email [email protected].
Withdrawing marketing consent won't affect messages I need to send you about an enquiry or transaction already in progress.
7. Who I share your information with
I do not sell your personal information. I share it only where necessary, with:
- Service providers (operators) who help me run my business — for example, my customer relationship management (CRM), email and SMS platform, and website and analytics providers. These providers process your information on my instruction and are required to keep it secure.
- Property and finance partners relevant to your enquiry — such as bond originators, banks, or conveyancing attorneys — where this is needed to help with your request and, where appropriate, with your knowledge.
- Authorities or advisors where I am legally required to disclose information, or to protect my legal rights.
8. Information processed outside South Africa
Some of the service providers I use may store or process your information on servers located outside South Africa. Where this happens, I take reasonable steps to ensure your information is protected by a comparable level of safeguards, as required by section 72 of POPIA.
9. How I keep your information secure
I take reasonable, appropriate technical and organisational measures to protect your personal information against loss, unauthorised access and misuse. No method of transmission or storage is completely secure, but I work to protect your information and to use service providers who do the same.
10. How long I keep your information
I keep your personal information only for as long as necessary for the purposes described in this policy, or for as long as the law requires me to. When information is no longer needed, I take steps to delete or de-identify it.
11. Cookies
Cookies are small files placed on your device that help a website function and help me understand how the site is used. You can control or delete cookies through your browser settings. Disabling some cookies may affect how parts of the site work.
12. Your rights under POPIA
You have the right to:
- Ask what personal information I hold about you, and request access to it;
- Ask me to correct or update information that is inaccurate or out of date;
- Ask me to delete or destroy information where appropriate;
- Object to the processing of your information in certain circumstances;
- Withdraw your consent at any time;
- Lodge a complaint with the Information Regulator.
To exercise any of these rights, email me at [email protected]. I will respond within a reasonable time.
13. Children's information
My website and services are intended for adults. I do not knowingly collect the personal information of children under 18 without the consent of a parent or guardian. If you believe a child has given me information, please contact me so I can remove it.
14. Links to other websites
My site and content may link to third-party websites and platforms (such as YouTube or social media). I am not responsible for the privacy practices of those sites, and I encourage you to read their privacy policies.
15. Changes to this policy
I may update this Privacy Policy from time to time. The latest version will always be posted on this page, with the effective date shown at the top.
16. How to contact me — and the Regulator
